Joint NEPA ROD/SEQRA Findings Statement
The Federal Highway Administration (FHWA), the New York State Department of Transportation (NYSDOT), and New York State Thruway Authority (NYSTA) have issued a Joint Record of Decision (ROD) and Findings Statement for the Tappan Zee Hudson River Crossing Project. This Joint ROD and Findings Statement has been prepared in accordance with the National Environmental Policy Act (NEPA), the Council on Environmental Quality (CEQ) regulations implementing NEPA, and FHWA’s regulations implementing NEPA. The Joint ROD and Findings Statement has been prepared in accordance with the State Environmental Quality Review Act (SEQRA) regulations and NYSDOT’s Procedures for the Implementation of SEQRA.
The Joint Record of Decision and Findings Statement together mark the final step in the EIS process and lay out the project alternatives considered along with the chosen alternative. Also included is the environmentally preferred alternative and information on mitigation measures, including environmental and monitoring commitments.
FHWA, NYSDOT, and NYSTA have selected the Replacement Bridge Alternative for the Tappan Zee Hudson River Crossing Project consisting of two new bridge structures across the Hudson River between the Village of South Nyack, Rockland County, New York and the Village of Tarrytown, Westchester County, New York. The two new bridge structures would be located north of the existing Tappan Zee Bridge and would meet the existing New York State Thruway right-of-way east of South Broadway in South Nyack (Exit 10) and west of South Broadway (Exit 9) in Tarrytown. This alternative is fully described in Chapter 2, “Project Alternatives”, of the FEIS.

This Scoping Summary Report incorporates information provided in the Scoping Information Packet for the Tappan Zee Hudson River Crossing Project, lists public and agency comments on the Scoping Information Packet, responds to the comments received, and includes updated information as necessary to address the public comments. Updated or revised text is shown in italics throughout this document. This document describes the purpose and need for the project (Section 1); the alternatives under consideration (Section 2); the framework for the project’s environmental analysis (Section 3); the public involvement program for the project (Section 4), and agency and public comments and responses (Section 5).

Final Environmental Impact Statement (FEIS)
FEIS Summary
The following document is a summary of the major mitigation actions outlined in the Final Environmental Impact Statement, a document compiled by agencies on all levels of government with comprehensive responses to thousands of comments from the public. It includes extensive actions that will be taken to mitigate public concerns, including installing 24-hour video cameras to document the project, noise monitors to measure construction noise and air quality monitors to assess emissions.
Transparency of Bridge Process
Continuing New York States commitment to an open, participatory process, this project has solicited early and continued feedback from the public and from agencies; encouraged open discussion of project details and issues; and has provided opportunities for comments and questions. These efforts will continue throughout the environmental review of the Tappan Zee Hudson River Crossing Project. Tools that have been and will continue to be used in the public involvement and information program include:

- Mailing list;
- Informational materials at key points during the project development process;
- Media outreach; and

This Final Environmental Impact Statement (FEIS) examines the potential environmental effects of proposed alternatives for the Tappan Zee Hudson River Crossing Project, and where adverse impacts are identified, it discusses measures to mitigate them. The FEIS incorporates comments received on the Draft EIS. The purpose of the project is to maintain a vital link in the regional and national transportation network by providing a new Hudson River crossing between Rockland and Westchester Counties, New York, that addresses the limitations and shortcomings of the existing Tappan Zee Bridge and meets the structural, operational, safety, security, and mobility needs of the Tappan Zee Hudson River Crossing.
Based on the findings of the DEIS and the written and oral comments received during the public hearings, as well as during the DEIS document public comment period (ending on March 30, 2012), FHWA, NYSDOT and NYSTA prepared a Final Environmental Impact Statement (FEIS).
FHWA, NYSDOT and NYSTA invite interested individuals, organizations, and Federal, State and local agencies to review the FEIS. The FEIS document will be available for public inspection during normal business hours at these locations . In addition, the document can be downloaded below.

Request For Proposals and Request For Qualifications
Request for Proposals (RFP) Process
On March 9, 2012 the Final Request for Proposals (RFP) was made available to the four firms on the short list who are eligible to submit proposals to design and build the new Tappan Zee Bridge.
To continue to promote an open and transparent procurement process, this RFP document is being provided for informational purposes only. No public comments relating to the RFP are being solicited or responded to. The Public Comment period is closed.
Section 1503 of SAFETEA-LU (August 10, 2005) revised design-build regulations to provide for increased flexibility in initiating the design-build procurement process as it relates to the completion of the environmental review process. This flexibility has been consistent with the Administration’s Every Day Counts Initiative, which encourages conducting project delivery concurrently to the extent allowable. It allowed State transportation departments to issue request for proposals and preliminary design work under design-build contracts prior to the completion of the NEPA process. This revision also allows states to realize sooner the advantages of time and cost savings and improved quality for projects that use design-build procurement. Since the RFP has been issued prior to the conclusion of the NEPA process, the document informs the proposers that no commitment will be made to any alternative under evaluation in the NEPA process, including the no-build alternative. The document includes appropriate provisions ensuring that all environmental and mitigation measures identified in the NEPA document will be implemented.

Request for Qualifications (RFQ) Process
The New York State Department of Transportation (NYSDOT) and the New York State Thruway Authority (NYSTA) – collectively, the Agencies – have issued a Request for Qualifications (RFQ) for firms interested in participating in the design and construction of a new bridge across the Hudson River near Tarrytown, New York. The RFQ sets out the pre-qualification process for firms seeking to be short-listed as project Proposers, and it provides details of the Statement of Qualifications (SOQs) required from interested firms. The deadline for submitting SOQs was January 10, 2012.

October 25 and 27, 2011 – Public Scoping Briefings
Nearly one thousand people attended the public scoping briefings on the proposed infrastructure improvements for the Tappan Zee Hudson River Crossing project.
The briefings were held from 4:00 to 9:00 PM on Tuesday, October 25, at the DoubleTree Hotel in Tarrytown, Westchester County, and on Thursday, October 27, at the Palisades Center in West Nyack, Rockland County.
Members of the public were given the option of presenting their comments in writing, at a microphone in front of an audience, or dictated privately to a stenographer.
The scoping process began with the publication of the Notice of Intent in the Federal Register on October 12, 2011.

Additional Environmental Studies
Environmental Stewardship is recognized as one of the primary responsibilities of the New York State Thruway Authority (Authority). Environmental Stewardship entails progressing projects and activities in compliance with regulations, while looking for opportunities to enhance the environment. Incorporating Environmental Stewardship into all projects and activities is paramount to the Authority.
To this end, the Tappan Zee Hudson River Crossing Project is moving forward swiftly to meet the ambitious scheduling goals set forth, but also moving forward in an environmentally sensitive manner. The Project is undergoing thorough and thoughtful environmental review and will comply with all applicable environmental regulations and policies. The Project design will undergo rigorous analysis and strive to avoid and minimize impacts to neighborhoods, environmental resources, historic sites, fish species, important habitat and other sensitive areas and resources that are important to the local communities’ quality of life. The Project Team is working closely with environmental agencies and partners to develop creative approaches which balance the needs of transportation with the importance of the environment. This critical collaboration ensures the environment is not only protected, but will ultimately benefit from the new Tappan Zee Hudson River Crossing.
The environmental review for the project is currently underway pursuant to the National Environmental Policy Act and the State Environmental Quality Review Act. As part of this process, an Environmental Impact Statement (EIS) is being prepared to examine the potential environmental effects of proposed alternatives for the Tappan Zee Hudson River Crossing Project, and analyze options to avoid and minimize impacts. Where adverse impacts are identified, the EIS discusses measures to mitigate the impacts and protect the environment. A Draft Environmental Impact Statement (DEIS) is available for viewing.
A unique environmental aspect of the Project is the presence of the federally endangered, Atlantic and Shortnose Sturgeon in the Project area. To protect the species, the DEIS has identified innovative mitigation measures to be tested in order to reduce underwater noise caused by construction activity which may injure fish. One innovative measure is the “bubble curtain”, which entails generating a dense shower of underwater bubbles surrounding a particular construction element, i.e., a bridge pile, that helps protect fish and other marine life by dampening sound during the pile driving. This measure, and several others, will be tested in the coming months. The most effective measures will then be utilized during construciton of the bridge.
In addition to testing and implementing mitigation measures, significant monitoring and analyses will be undertaken inlcuding; measuring of hydro-acoustic (underwater sound) levels, conducting fish studies, and monitoring bird feeding activity, which may be an indicator of fish injury or mortality. This information will be utilized to expand the breadth of knowledge of the effects of hydro acoustic levels on fish behavior and the development of best practices to protect fish from potentially harmful sound levels. The Project Team is working closely with federal and state regulatory agencies on these important initiatives.
Not only is protecting endangered species critical, an important aspect of this project is to improve operational deficiencies of the bridge, which will provide environmental benefit. Specifically, some features of the proposed replacement bridge options would reduce pollutant emissions as compared to the No Build Alternative. For example, the Replacement Bridge Alternative would replace the existing lanes (portions of which are approximately 11 feet wide) with 12-foot-wide lanes, improving safety on the bridge. The replacement bridge would also introduce shoulder areas for vehicles involved in accidents and breakdown incidents and for emergency vehicle access, thereby improving the traffic flow and reducing the substantial delays that these incidents cause. In addition, the introduction of three highway-speed toll lanes (replacing the two existing 35 mph lanes) would reduce congestion and idling emissions at the toll plaza.
Another endangered species, the peregrine falcon, nests in boxes on the existing Tappan Zee Bridge. To avoid disturbing any falcons nesting on the bridge during construction, activities would be distanced as far from the nest boxes on the existing bridge as possible. Protocols developed for minimizing disturbance to bridge-nesting peregrine falcons during maintenance and construction would also be followed to the greatest extent possible during the February through August nesting period. These may include prohibiting construction activities, where practicable, at heights greater than 26 feet above the roadway or within 100 feet of the piers over which the nest boxes are located, and marking the tops of heavy equipment (e.g., cranes) and any tall exhaust pipes of such equipment with flagging to deter peregrine falcons from landing on them. It is possible, upon completion of the replacement bridge, and prior to demolition of the existing bridge, nest boxes would be moved to the replacement bridge to provide an alternative nest site for the resident pair of peregrine falcons to utilize in future breeding seasons. Consultation with the New York State Department of Environmental Conservation wildlife biologists is currently underway to identify the best options for relocating the nests to help ensure a successful transition for the peregrine falcons.
